Connecticut Expands Workers’ Compensation for PTSD to All Employees

Connecticut has ushered in a significant expansion of workers’ compensation benefits, now including coverage for post-traumatic stress injuries or disorders (PTSD) for all employees. Before January 1, only first responders were eligible for such benefits. The new law (SB913) changes this, making any employee eligible if a mental health professional diagnoses PTSD as a direct result of specific traumatic events encountered in the course of employment.

This expanded coverage includes witnessing death, serious injuries, or dealing with deceased minors in the workplace. However, the qualifying event must be a substantial factor in the injury, and it cannot result from standard employment actions like layoffs or promotions. The law maintains the same procedures and limitations as PTSD benefits for first responders, with benefits capped at 52 weeks and claims limited to within four years of the event.

The legislation faced mixed reactions. Labor unions and nursing professionals advocated for it, emphasizing the mental health challenges and high PTSD rates in their professions. In contrast, insurers and business representatives expressed concerns over the financial implications. They fear increased premiums and costs for employers, given the subjective nature of PTSD and potential for abuse in claims.

Connecticut’s workers’ compensation law has traditionally excluded mental stress claims unless connected to a physical injury or occupational disease. This expansion, therefore, marks a significant shift, raising concerns about the potential financial impact on employers, especially small businesses and municipalities. This development in Connecticut’s approach to workers’ compensation reflects a growing awareness of mental health in the workplace and the balance between employee welfare and economic implications.
